meaning of terms in this document

The term “Geopathic Care” or “GC” refers to
Geopathic Care. Geopathic Care is the trading name of Drumkerrin Eco Products Limited, 43 Eastlink Business Park,
Limerick, Ireland.

The term “Client” or “You” refers to the user of
this site, or the purchaser of goods from GC, or the recipient of services form GC.

“Services” means the service to be provided by
Geopathic Care to the Client.

You may access the Site solely for your own
personal use. You must not use any content of the Site for any commercial or illegal purpose. We reserve the right
to suspend the Site at any time for operational, regulatory, legal or other reasons.

The Site and its content are protected by
intellectual property rights. Except as expressly authorised by us you agree not to copy, download, adapt, alter,
modify, rent, lease, loan, sell, distribute any content of the Site, in whole or in part.

Your use of the Site is at your sole risk. The
Site is provided on an "as is" and "as available" basis and we do not guarantee that the Site will be suitable for
your purposes or requirements. The content of the Site has been compiled from a variety of sources and is subject
to change without notice. We use reasonable care in compiling and presenting the content of the Site, but we give
no guarantee that the content is complete, accurate, error or virus free or up to
date, and
shall not be liable, for any damages that
may result from the use or non-use of any of the content of this website.

This agreement is subject to the laws of the
Republic of Ireland.
Terms and Conditions for the provision of
services
10 The terms and conditions set out in this Agreement shall
govern the contract between GC and the Client for the provision of the Services.
11 All work carries out by GC will be quoted for in
advance
12 All promotional material issued by GC is for the sole
purpose of giving an approximate idea of the Services described in them, and shall not form part of this
Agreement.
13 GC shall be paid for Services provided immediately upon
completion of the site visit
14 In the event where GC has attended site by appointment and is
unable to complete work due to the absence of the client, the inability to gain access, or any other reason, the
client is liable for the agreed price of the visit.
15 The Client undertakes at all times to provide a safe
environment for GC, it’s agents or sub-contractors who attend a premises which are under the Client’s ownership
and/or control.
16 GC will use reasonable skill and care in providing the
Services. GC provides no warrantee or guarantee of the effectiveness of the service provided on the
client.
17 Client indemnifies GC against any liability resulting from
damage caused in the course of the consultancy. In particular, where GC seek approval to sink metal objects into
the ground and said approval is granted, the Client absolutely indemnifies GC against any damage or harm that is
caused whatsoever as a consequence of this action.
18 In any event GC’s liability to the Client shall not exceed the
contract value.

for purchase of goods
19 You warrant that you are over the age of 16.
20 You place the order for Your Products on the website by
pressing the confirm order button at the end of the check-out process. You will be guided through the process of
placing an order by a series of simple instructions on the website.
21 We will send to You an order acknowledgement email detailing
the products You have ordered. This is not an order confirmation or order acceptance from Us.
22 When Your product is shipped from our warehouse We will send
you a dispatch confirmation email.
23 You acknowledge that any automated acknowledgement of Your
order which You may receive from Us shall not amount to Our acceptance of Your offer to purchase Goods. Order
acceptance and the completion of the contract between You and Us will take place on the dispatch to you of the
Products ordered or when We debit Your credit or debit card, whichever is the earlier.
24 As part of the purchasing process, you have the option to
register on the GB Site. You must choose a username and password on completion of registration. You are responsible
for all actions taken under that username and password and shall only use the Site under your own username and
password.
25 You warrant that the Information which You are required to
provide when You make an offer to buy Goods is true, accurate, current and complete in all respects.
26 All credit/debit card holders are subject to validation
checks and authorisation by the card issuer and We may share Your personal information with such third parties as
are necessary to enable Us to do such checks. If the issuer of Your payment card refuses to authorise payment to
Us, we will not be liable for any delay or non-delivery
27 Transfer of title (ownership) shall pass to you when the
goods have been delivered to the delivery address detailed on your order and payment for the goods has been
received in full.
28 Risk in the goods shall pass to you when the goods have been
delivered to the delivery address detailed on your order. In the event of goods being returned, the risk in the
goods will return to Us when the goods being returned are received by Us.
29 We aim to deliver all orders within 6 working days and in any
event attempt to dispatch all Orders within 2 working days of receiving them, but allow up to a maximum of 28 days
for delivery.
30 VAT at the standard rate of 21% is added to all
Orders
31 Returns procedure; Prior to any returns, you must contact us
by e-mail on info@GeopathicCare.com and inform us of your return. We
will issue all approved returns with a Returns Authorisation Number (RAN). The RAN will be e-mailed by return and
include information on how to return the Goods and where to send them to. We may refuse any returns that do not
have a valid RAN. Authorised product returns must be sent to:

32 If you are a private consumer you may cancel your purchase at
any time within 7 working days from the day after receipt of the Goods without incurring any obligation or
liability to us. Provided that you follow the returns procedure detailed above, and that the goods are received by
us properly packaged in good condition and as they were when delivered to you, having not been used, and returned
at your cost by sending it special delivery to the Geopathic Care Web Returns (address above) you are entitled to a
full refund. If you do not return the Goods to us in accordance with this Agreement, you must make the Goods
available for collection and we may charge you the direct commercial costs that we incur to collect
them.
33 If, after notifying us of your intention to cancel you have
failed to return your Goods to Us by sending them to the Geopathic Care Web Returns address within 21 days, or you
fail to make them available for collection if collection had been agreed, you hereby irrevocably agree to pay
Geopathic Care the retail price of the Goods and you authorise us to take this amount from your credit or debit
card or through such other means as we may require. In the event that you have failed to make them available for
collection as requested, you also accept liability for the direct cost incurred by us in attempting to retrieve the
goods.
34 If you cancel your contract, subject to the goods having
being returned in accordance to our returns policy, we will refund the monies you have paid to us within 30 days of
you giving notice under the relevant contract.
35 In the event that we dispatch damaged goods or the wrong
goods to you, Geopathic
Care will offer you a
replacement or refund. You must advise us of the problem within 7 days of receipt of the Goods and use the standard
returns procedure detailed above.
Your Personal
Information
36 We respect your personal information and undertake to comply
with applicable Data Protection legislation in place from time to time.
37 We may hold information that you provide to us and may share
Your Information within the organisation. In the event that we undergo re-organisation or are sold to a third party
you agree that Your Information may be transferred to that re-organised entity or third party for the purposes and
subject to the terms of this Agreement.
38 Your Information may be held and used to processing your
orders or applications; administering your account and billing; disclosing your data to bank and debit and credit
card companies to validate your debit or credit card details; dealing with requests, enquiries or complaints and
other customer care related activities; debt recovery (also using recovery agents and agents facilitating to
contact you) and legal actions and all other general administrative and business purposes or; to carrying out
market and product analysis to develop and improve products and services or ; carrying out any activity or
disclosure in connection with a legal, governmental or regulatory requirement on us or in connection with legal
proceedings, and for the prevention and detection of crime or fraud and the prosecution of offenders or suspected
offenders.
General
39 While we will use reasonable endeavours to verify the
accuracy of any information We place on the Website, We make no warranties, whether express or implied in relation
to its accuracy.
40 We make no warranties of any kind, whether express or
implied, in relation to the Website, or any transaction that may be conducted on or through the Website, or in
relation to the Goods including but not limited to, implied warranties of satisfactory quality, or fitness for a
particular purpose. In addition, Geopathic Care does not warrant or represent that the information available via
this site is current, complete or accurate.
41 Notwithstanding any other provision in the Conditions,
nothing herein shall limit Your rights as a consumer under EU and Irish law.
42 In the event of action taken by you against Geopathic Care,
Geopathic Care’s liability is limited to a value that will not exceed the value of the individual sale that is the
subject of such action.
43 The Conditions shall be governed by and construed in
accordance with Irish law and you irrevocably submit to the exclusive jurisdiction of the courts of
Ireland.
44 If any part of the Conditions shall be deemed
unlawful, then that provision shall be deemed to be severable from these Conditions and shall not affect the
validity and enforceability of any of the remaining provisions of the Conditions. If a condition is deemed
unlawful, it shall be replaced with a condition that has the closest meaning to the meaning of the original
unlawful condition, and is deemed lawful.
45 Geopathic Care shall not be liable for failure to comply with
these Conditions owing to any act or event beyond its control including but not limited to Acts of God, industrial
action, civil commotion, strikes, shortage of supplies, war, natural disasters, riots, lock-outs, disease or
fire.
46 These Conditions (as amended from time to time) contain the
entire agreement between You and Geopathic Care relating to the subject matter covered and supersedes any previous
agreements, arrangements, undertakings, representations or proposals, written or oral, between You
and Geopathic Care in relation to such matters. You confirm that You have read these conditions and, You
fully understand them and You also agree that these conditions are the only terms that rule Your relationship with
us.
